Guidance Note Up-Date on Ozone (ODS) and F Gas Regulations - July 2009

| We are all very aware of the forthcoming Ozone Depleting Substances (ODS) and F Gas Regulations as this legislation has been talked about, discussed and publicised in the trade press for many months, but as is always the case when new European legislation is introduced, the central core is laid down in Brussels and each member state works towards interpreting a workable solution in its own geographic environment; the same is true of both of these pieces of legislation. |

| It has become increasingly apparent from the calls we receive and the training sessions we have been part of that there is still a great deal of inaccurate information and misinterpretation circulating in the industry and we felt the time was right to produce a definitive piece of work setting out the current situation particularly in light of the ODS rules having just been up-dated as from 1 July and the F Gas company certification scheme now being in place and operational. |

| This legislation is constantly evolving, in fact during the time it took to produce this data a further two company certification bodies have been accredited by DEFRA in addition to REFCOM. |

European Refrigerant Regulations

| The EU Parliament has now formally agreed that Member States will adopt the regulations concerning ozone depleting substances to replace the existing regulation 3093/94. It is anticipated that the Council of Ministers will approve the recommended legislation in its entirety before the commencement date of 1st October 2000. |
| The regulations affecting CFC's are fairly clear and concise, but the HCFC (R22) situation needs a little care in the way we understand it, since it sets out various exemptions based on shaft input power, total cooling capacities and types of system. |
